Kuwait End-of-Service Indemnity & Expat Money Rights

Kuwait’s indemnity has two traps most calculators fall into. First, the wage basis: Article 55 counts total remuneration — allowances included — while nearly every online calculator uses basic salary only. Second, the daily-wage divisor: pages claim “÷26 as per labor law,” but the law states no such divisor — it is payroll convention. Here is Law No. 6 of 2010, Articles 51–55, done right.

The one-minute version

  • Formula (monthly-paid): 15 days’ wage/yr for the first 5 years, 1 full month’s wage/yr after.
  • Wage basis: total remuneration per Article 55 (basic + allowances + periodic extras) — disputed in practice; see below.
  • Cap: 1.5 years’ wages (18 months) for monthly-paid workers.
  • Minimum: none in the statute for termination cases (some sites claim 1 year — no statutory basis found).
  • Resignation: tiers apply on unlimited contracts — 0 / ½ / ⅔ / full at 3, 5, 10 years.

The wage-basis dispute (read this before you calculate)

Article 55 of Law No. 6 of 2010 defines “wage” as basic salary plus all contract elements, allowances, remunerations, commissions, grants and periodic cash privileges. That is a total-remuneration basis — considerably broader than the “basic only” rule most expat calculators apply. In practice, many employers and calculators still use basic salary only, and real PAM/court practice on disputed cases is not publicly documented. Our calculator uses the statutory total-remuneration basis and flags the dispute, so you know exactly what you might be owed versus what calculators usually show.

Frequently asked questions

How is Kuwait end-of-service indemnity calculated?

For monthly-paid workers under Article 51 of Law No. 6 of 2010: 15 days’ wage per year for the first 5 years, then one full month’s wage per year after that. The total is capped at 1.5 years’ wages (18 months).

Is Kuwait indemnity based on basic salary or total salary?

Article 55 defines “wage” broadly: basic salary plus all contract elements, allowances, commissions and periodic cash privileges — a total-remuneration basis. Most online calculators wrongly use basic salary only.

What is the maximum Kuwait indemnity?

For monthly-paid workers, 1.5 years’ wages (18 months). For daily/weekly/piece/hourly workers, the cap is one year’s wage.

Does resigning reduce Kuwait indemnity?

On unlimited contracts, yes — Article 53 tiers: nothing under 3 years, half from 3 to under 5 years, two-thirds from 5 to under 10 years, full at 10+ years. Employer termination, fixed-term expiry and a woman resigning within a year of marriage pay the full amount.
